TERMS OF SERVICE

1. DEFINITIONS

For the purposes of these Terms of Service, the following definitions apply:

• "Account" means the unique account created for you to access our Service.
• "Platform" or "App" means the dMAT Prep web application.
• "Company" refers to ABHYASHALA TECHNOLOGY PRIVATE LIMITED.
• "Content" means all text, images, practice questions, logic breakdowns, mock exams, visual interfaces, and other materials available through the Platform.
• "Free Features" means the features and content available to all Users without a purchase (e.g., Diagnostic test).
• "Premium Content" means the features, content, and functionality (e.g., Full Mock Exams) available exclusively through one-time purchases.
• "Service" means the dMAT Prep application and all related services and functionality.

2. ACCEPTANCE OF TERMS

By accessing or using dMAT Prep, you affirm that:

• (a) You have read, understood, and agree to be legally bound by these Terms;
• (b) You have the legal capacity to enter into this Agreement;
• (c) You are at least 13 years of age (or 16 where required), or using it with the consent of a legal guardian;
• (d) You will comply with all applicable local, state, national, and international laws.

3. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Material changes will be communicated via the Platform or email. Your continued access to or use of the Service after modifications become effective constitutes acceptance of the revised Terms.

4. DESCRIPTION OF SERVICES

4.1 Service Overview

dMAT Prep provides test preparation materials, including:

• (a) Diagnostic Tests: A mini-mock test assessing basic readiness;
• (b) Full-Length Mock Exams: High-fidelity simulated exams mirroring the official dMAT;
• (c) Logic Breakdowns: Step-by-step explanations for quantitative and logical reasoning questions;
• (d) Progress Tracking & Percentile Rankings.

4.2 Educational Purpose & Disclaimer

Our Service is intended for educational and preparation purposes only. We do not guarantee specific test scores, admission to any university, or absolute accuracy of all materials. The platform provides a simulated experience and is not officially affiliated with g.a.s.t. or APS India.

5. ELIGIBILITY

You must be at least 13 years of age (or 16 in certain jurisdictions) or use the App under the supervision of a parent/legal guardian who accepts these Terms.

6. ACCOUNT REGISTRATION AND SECURITY

You are responsible for providing accurate registration information and maintaining the security of your credentials. Each User may only maintain one Account, and Account sharing is strictly prohibited. We actively monitor for account sharing and enforce this via single-device session guarding. Violations will result in immediate account termination without refund.

Account Deletion: You have the right to request deletion of your account and data at any time by emailing contact@dmatexam.com.

Termination Rights: We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Service at our sole discretion, at any time, for any reason, with or without notice.

7. PURCHASES, PAYMENTS, AND BILLING

7.1 One-Time Purchases

dMAT Prep offers both Free Features and Premium Content accessible via one-time module purchases (e.g., Pro Tier, Premium Tier). We do not operate on a recurring subscription model.

7.2 Payment Processing

All payments are processed securely through third-party payment gateways (Razorpay). We do not store your payment card information.

7.3 Access Duration

Purchased modules grant unlimited access for 6 months from the date of purchase, unless specified otherwise at checkout.

7.4 Purchasing Age Verification

You must be at least the age of majority in your jurisdiction to make a purchase. If you are under the age of majority, you must have your parent or legal guardian's permission to make a purchase.

8. USER CONDUCT AND CONTENT PREVENTION

You agree not to engage in security violations, harassment, intellectual property infringement, or commercial misuse.

Content Protection: Content sharing, automated scraping, copying of questions (via screenshots, copy-paste, or other means), and unauthorized distribution of our materials is strictly prohibited. The platform employs anti-scraping mechanisms to prevent content theft. Any attempt to steal or distribute content will result in immediate termination of your account without refund and may lead to legal action.

9. CANCELLATION AND REFUNDS

Please refer to our separate Refund Policy for detailed information on cancellations and refunds. Generally, all sales of digital products are final once accessed.

EU/UK Right of Withdrawal: For users residing in the European Economic Area (EEA) or UK: You have a 14-day right of withdrawal from the date of purchase. To exercise this right and request a refund, you must notify us by emailing contact@dmatexam.com within the 14-day period and provide valid proof of residency in the EEA or UK. Users outside the EEA or UK are not eligible for refunds once access is granted.

10. INTELLECTUAL PROPERTY RIGHTS

The Service, simulated tests, logic explanations, and all Content are owned by the Company and protected by copyright/trademark laws. You receive a limited, non-transferable license for personal, educational use.

Feedback Ownership: Any feedback, comments, or suggestions you may provide regarding the Service is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation or compensation to you.

11. DISCLAIMERS

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT CLAIM TO HAVE THE EXACT EXAM FORMAT OR CONTENT AS THE OFFICIAL TEST. WE EXPLICITLY DISCLAIM ANY WARRANTIES REGARDING THE ABSOLUTE ACCURACY OF MOCK QUESTIONS. WE DO NOT GUARANTEE EXAM SCORES OR UNIVERSITY ADMISSION OUTCOMES.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST SIX (6) MONTHS, OR TEN US DOLLARS ($10), WHICHEVER IS GREATER.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; or (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

14. FORCE MAJEURE

Company shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, server outages, or third-party service failures.

15. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by the laws of India. The courts in New Delhi, India shall have exclusive jurisdiction.

16. DISPUTE RESOLUTION

We encourage attempting informal resolution first. If unresolved, disputes will be settled through binding arbitration in New Delhi, India under the Arbitration and Conciliation Act, 1996.
